Welcome
St Vincent's Hospital Sydney Limited (hereafter referred to as "SVHS", "We" or "Us") provides the possibility to communicate with an Alcohol and Drug Information Service (ADIS) counsellor in real-time using a web chat platform (the "ADIS Web Chat" or "ADIS Web Chat platform"). ADIS counsellors can provide counselling, referrals, support and information about alcohol and drug related issues.
These Terms and Conditions of Use outline the terms under which you may access and use the ADIS Web Chat platform.
If you choose not to use the ADIS Web Chat platform or the service is not currently available, you can access information, counselling, referral and support via the ADIS Helpline in NSW on 1800 250 015. Similar helplines are available in other Australian cities, please visit Getting Help for the relevant contact numbers.
Health care disclaimer
The ADIS Web Chat service is to provide initial point of contact for support and counselling for alcohol and drug issues and should not be used or relied upon as a substitute for a consultation or visit with your physician or other health care provider. The diagnosis and treatment of a clinical condition can only be undertaken in person by a qualified healthcare professional. You should always seek the advice of a qualified healthcare professional with any questions you have regarding your health or a medical condition.
If you (a) require urgent medical attention or (b) are in immediate danger or (c) are at risk of harming yourself or someone else, call Emergency Services on 000.
Eligibility for Access
ADIS Web Chat is solely for use by users of the ADIS service in New South Wales. To be eligible to use ADIS Web Chat you must be 16 years of age or older. We have the sole right to determine your eligibility for, and the extent of your access to, ADIS Web Chat.
Appropriate use of ADIS Web Chat
You must only use ADIS Web Chat for the purposes described in these Terms and Conditions of Use. You must not use or attempt to use ADIS Web Chat to:
- corrupt, damage or interfere with ADIS Web Chat or any SVHS or third party data, software, hardware, website or information technology systems
- send any offensive, inflammatory, defamatory, fraudulent or otherwise unlawful information or information that infringes third party rights
- adversely affect the reputation or public image of SVHS
- cause annoyance or inconvenience to SVHS, its staff and personnel or any third party.
You acknowledge that SVHS can terminate your use of ADIS Web Chat if SVHS reasonably believes that you have breached these Terms and Conditions of Use.
Communications
During your Web Chat with an ADIS representative, you may provide personal information including your:
- email address if you would like us to email information to you
- postal address if you would like us to post information to you and/or
- telephone number if you would like us to contact you following the Web Chat for follow up purposes or for a referral to an appropriate service within our organisation.
In providing SVHS your email address, telephone number and/or your postal address, you consent to SVHS using your email address and/or telephone number to contact you for the above purposes or as permitted by applicable laws and regulations.
Privacy
Any personal information (including personal health information) you provide during your use of the ADIS Web Chat platform will be collected by SVHS in its capacity as the Web Chat service provider. SVHS will handle the Information it collects about you in accordance with these Terms and Conditions of Use and the SVHS Privacy Policy.
SVHS will not disclose your personal details or sensitive information to a third party unless legally required to do so or as consented to by you or as set out in these Terms and Conditions of Use or Privacy Policy.
You may choose to access and use ADIS Web Chat on an anonymous basis and/or nominate an alias for use by the ADIS representative during your use of the Web Chat platform, however, this will limit SVHS's ability to provide any follow up, where required.
If you provide personal identifying information about another person as part of your use of the ADIS Web Chat platform, you must ensure that, prior to providing the personal identifying information about that person, the person is aware of how their information will be handled under these Terms and Conditions of Use and that they consent to the handling of their information in accordance with these Terms and Conditions of Use.
Intellectual property rights
You acknowledge that all intellectual property rights (including copyright) regarding ADIS Web Chat including the transcripts of any Web Chat ("ADIS Materials") is owned by or licensed to SVHS. You may not otherwise use, copy, change, communicate, sell or otherwise deal with the ADIS Materials without SVHS's express prior written consent.
De-identified information from chats (including chat transcripts) may be used for training purposes, reporting or research.
Terms of use
We reserve the right to change, suspend or discontinue all or any aspects of the ADIS Web Chat platform and service at any time without prior notice.
Termination of use
We reserve the right (but are not obliged) to:
- remove communications that fail to conform with these terms of use
- terminate a user's access to the entire service or specific features
- edit or delete any communications, regardless of whether such communications violate these standards.
Liability
SVHS cannot and does not assume any responsibility or liability for any information you submit while using ADIS Web Chat or misuse of information transmitted or disclosed via the Web Chat platform. SVHS does not warrant or represent that the information you submit via the ADIS Web Chat platform will be protected against loss, misuse or alteration by third parties.
You understand and agree that the ADIS Web Chat platform and any services, content or information contained on or provided by or through the ADIS Web Chat platform is provided on an "as is" basis.
SVHS does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the service or any information provided through the service. In addition, we do not guarantee that use of the ADIS Web Chat platform will be free from technological difficulties including, but not limited to unavailability of information, downtime, service disruptions, viruses or bugs.
To the extent permitted by law, St Vincent's Hospital Sydney Limited excludes all liability for any loss or damage whatsoever (including consequential or incidental damage) and however arising (including due to negligence) that you may suffer, directly or indirectly, in connection with your use of the ADIS Web Chat platform (including the use of any links). In particular, we exclude all liability for any loss or damage that may result from your use of, or reliance upon, any information or material obtained from use of the ADIS Web Chat platform.
Indemnification
You agree that you will indemnify the St Vincent's Group (as defined below) and any officers, employees and agents of the St Vincent's Group against any liability including third party claims, loss, damage, or expense (including legal costs on a solicitor and client basis) incurred or suffered as a direct or indirect result of or arising out of or in connection with (i) your use of the ADIS Web Chat platform and/or (ii) your reliance upon any information provided to you from use of the ADIS Web Chat platform and/or (iii) any breach by you of these Terms and Conditions of Use.
St Vincent's Group includes:
- The Congregation of Religious Sisters of Charity of Australia;
- Trustees of St Vincent's Hospital Sydney
- Trustees of the Sisters of Charity of Australia;
- Trustees of Mary Aikenhead Ministries;
- St Vincent's Health Australia Limited;
- St Vincent's Hospital Sydney;
- St Vincent's Private Hospital;
- any:
- Related Body Corporate;
- joint venture; or
- trust
which is controlled, associated or affiliated with any of (i) to (vi).
Links to third party websites
The ADIS Web Chat platform may be linked through other third party websites, including through the Your Room website, however, we do not warrant the accuracy, currency, quality, suitability, reliability or correctness of the information on any third party websites nor do we endorse any third party website. In addition, we are not responsible for the content or the privacy practices of any third party website.
The ADIS Web Chat platform must not be linked to any third party website without the prior written consent of SVHS. SVHS reserves the right to prevent linking at any time at its sole discretion.
General
These Conditions of Use are governed by the laws in the State of New South Wales, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of that State and all courts with jurisdiction to hear appeals from those courts.

By using the ADIS Web Chat you accept these terms and conditions. Do not use the ADIS Web Chat unless you have read and accepted all these terms and conditions. If you do not accept the terms, then do not continue to use the ADIS Web Chat.
